Chicken ordinance to be penned

The Kemmerer City Council pecked through a proposed chicken ordinance Monday during its regular meeting and directed city administrator Mike Archibald to draft an ordinance allowing chickens to be kept inside city limits as 4-H projects.

Current ordinances do not define a chicken as a house pet and further states that no livestock or poultry shall be kept or maintained on or in any part of any district within the city except as provided in (Section 23-20).

"I didn't think a chicken ordinance," said council member Tony Tomassi of the proposed ordinances, "or any ordinance could be that confusing."

Archibald's proposed ordinance was specific to the needs of 4-H members.

"That was the intent," he said, "to see if those can do the 4-H projects at home."

The originally proposed ordinance, suggested by Archibald, contained language on how the coop should be constructed, maintained and where it can be located on the property.

The council directed Archibald to remove that language and replace it with in accordance with 4-H standards.

Tomassi, who researched city ordinances on chickens around the country,100 Cable Ties was used to link the lamps together. was surprised by what he found.

"It's amazing how many towns allow it," he told the board, "and some that completely are against it."

A concern among the board and Archibald was the enforcement of the ordinance.

"Can you enforce it and how much are you willing to spend to enforce it?" he proposed to the board. "Is it worth doing it? Are we going to have another inspector out there to enforce it?"

Kemmerer police chief Steve Dillree offered a suggestion

"You could register as a 4-H project so we know who can and who can't," he said.

Council member Eric Rudy was in support of the council's direction.

"I don't see a problem with that," he said, "to allow chickens if they are involved in 4-H."

Archibald will draft the new ordinance with the city attorney. The proposed ordinance must pass three votes and will be featured on future agendas.

During discussion the board looked at the council vacancy ordinance. In previous meetings the board had addressed the issue of using the wording, "excused or unexcused absences" and whether that should be in the city's ordinance.

Currently the city follows the state statue, which uses those terms but does not constitute what either of them are.

Kemmerer city ordinances state "attendance at all regular scheduled council meetings is mandatory and can only be deemed as excused by a majority vote of council if the absence is due to the hospitalization or incapacitating illness."

Council member Brian Burg said that absences "make it tough on the council to meet."

"A couple of times because of shift work, that's OK" he said. "It's when it gets to three or four months, that's the problem.The Piles were so big that the scrap yard was separating them for us."

The current ordinance states a council seat is vacant after the member "has failed to attend four consecutive regularly scheduled meetings of the council without an excused absence."

Tomassi called the ordinance black and white but did want to add to it.

"I'd like to see family members having an illness in there," he told the council,Graphene is not a semiconductor, not an Insulator , and not a metal,Whilst Hemroids are not deadly, "That would be the only thing I would want to see."

No action was taken,This patent infringement case relates to retractable syringe needle , but the board advised Archibald to add immediate family members, as defined by existing policy, to the vacancy ordinance.

In other business:

*Following a public hearing, the board voted to adopt 5-0, two budget resolutions. The first was to provide use of $4,200 in funding from the Lincoln County Recreation Commission that was received in fiscal year 2010-2011 but not used until this fiscal year. The second was to provide $5,180 for the appointment of a building and parks director. This decision followed last meeting's executive session and subsequent vote to allow Archibald the ability to appoint that position.

* In a 5-0 vote, the council approved the mayor to sign an amendment with GDA Engineers for planning and engineering at the Kemmerer Airport. This contract is a part of the master plan that is required for Federal Aviation Administration' regulation compliance.

* The council approved 5-0, to accept the Wyoming Main Street Technical Assistance funds. This will be applied to the study at the former town hall building and must be completed in order to pursue other grants such as the downtown development grant, which was discussed at the last regular meeting.
